Have questions about your car accident claim?
Read our Car Accident FAQ →Florida's no-fault insurance system and 2023 tort reform significantly affect how car accident claims work. Understanding these rules is essential to protecting your recovery.
Florida's 2023 tort reform reduced the statute of limitations for negligence claims — including car accidents — from 4 years to 2 years from the date of the accident (§95.11(3)(a) as amended). Missing this deadline permanently bars your claim. Contact us immediately.
Florida requires all drivers to carry Personal Injury Protection (PIP) covering 80% of medical bills and 60% of lost wages up to $10,000, regardless of fault. To sue the at-fault driver for pain and suffering, your injuries must meet the serious injury threshold — permanent injury, significant scarring, or death (§627.737).
Florida's 2023 tort reform adopted a modified comparative fault rule. If you are found more than 50% at fault, you cannot recover any damages. If you are 50% or less at fault, your recovery is reduced by your percentage of fault. An attorney can protect your claim from inflated fault assignments by insurers.
