Florida Car Accident Law Explained

Florida's no-fault insurance system and 2023 tort reform significantly affect how car accident claims work. Understanding these rules is essential to protecting your recovery.

Statute of Limitations

Florida's 2023 tort reform reduced the statute of limitations for negligence claims — including car accidents — from 4 years to 2 years from the date of the accident (§95.11(3)(a) as amended). Missing this deadline permanently bars your claim. Contact us immediately.

No-Fault / PIP Insurance

Florida requires all drivers to carry Personal Injury Protection (PIP) covering 80% of medical bills and 60% of lost wages up to $10,000, regardless of fault. To sue the at-fault driver for pain and suffering, your injuries must meet the serious injury threshold — permanent injury, significant scarring, or death (§627.737).

Modified Comparative Fault

Florida's 2023 tort reform adopted a modified comparative fault rule. If you are found more than 50% at fault, you cannot recover any damages.
