Florida's Wrongful Death Act (§768.16–768.26) governs who can sue, what can be recovered, and how long you have to act.
Under Florida Statute §95.11(4)(d), wrongful death claims must be filed within 2 years of the date of death. This deadline is strictly enforced. Unlike personal injury claims, there is no discovery rule extension — the clock starts on the date of death, not when you learned the cause.
Florida requires the personal representative of the estate to file the lawsuit — not individual family members directly. If no estate has been opened, one must be established through probate court. We coordinate this process so your family can focus on healing while we handle the legal work.
Florida uses a modified comparative fault system (as of 2023). If the deceased was more than 50% at fault, the family cannot recover.
